Your terms and conditions of use

1. Introduction

1.1 Please read the following terms and conditions ('Agreement') carefully as any purchase of products will be subject to these terms and conditions. They set out the agreement between Universal Traders Ltd (referred to in this Agreement as "we", "us" or "our") and you ('You' means the person, persons or company viewing this website or placing an order on the website).

1.2 It is your own responsibility to ensure that you are fully aware of all of these terms and conditions when making a purchase on this site.

1.3 These terms and conditions can be altered at any time, and you should confirm that you have read them on each and every purchase.

1.4 These terms do not affect any statutory rights you may have by law. Please note all cases will be dealt with under the laws of Gibraltar.

2. Description of Services and Merchandise

2.1 The description of the merchandise can be found on the Site. We do our best effort to ensure that the goods that are supplied to you are identical to those on the Site, although there may be minor variations to the description and/or specification of the goods due to the changes made by the manufacturers.

Pictures and photographs of the goods on the site are for illustrative purposes only, and may not exactly match the goods.

2.2 All brands, logos, etc are copyrighted and belong to the individual company concerned. No use of this material may be made without the express approval of the copyright holder.

3. The contract of sale

3.1 We reserve the right to cancel any order at any time prior to delivery, for any reason. Acceptance of your order through our automated system does not constitute a contract, and this will only take place upon despatch of the item(s).  Either party may cancel any order prior to despatch.

3.2 Despite our best efforts to maintain an error-free website, on some occasions, an item may be priced incorrectly. If you purchase a miss-priced item, we reserve the right to cancel the contract and re-list the product at the correct price. You will be informed of the difference in price and you will have to re-order the item should you wish to proceed with the purchase. Any payments received will be refunded should you wish to cancel the order.

3.3 All items displayed as “available” are held in stock and will be despatched within 2 working days. If for any reason any item becomes unavailable in the interim period, you will be notified and advised of the expected delivery date. You will then have the right to cancel or proceed with the purchase. No compensation of any type will be entertained.

4. Privacy

4.1 We only store necessary information required to make a purchase. Your credit card information is NOT stored by us and is always processed across a secure server, using PayPal and/or WorldPay as the online payment provider. Both these companies are recognised as the most secure and reliable online payment providers.

4.2 All your personal information held with us is strictly confidential and we will not divulge or sell to any third party.

5. Security

5.1 Your IP is logged when placing an order. This is for reasons of fraud protection. All orders are scanned strictly for fraud by our fraud department before they are shipped. If you specify a different shipping address to the billing address then your order may take longer as we have to perform the necessary checks. Fraudulent or suspicious orders may be disclosed to the appropriate authorities on their legal request.

6. Delivery

6.1 Any items ordered will be delivered to the address as specified in your order. Any wrong delivery arising from an incorrect or incomplete address supplied may incur extra costs and time.

6.2 If for any reason at all you do not accept delivery of any of the goods in accordance with this paragraph, then we may charge you an additional fee to cover any reasonable additional direct costs incurred by us. This as a result could include additional insurance, delivery, storage or similar charges.

6.3 The items will be delivered as fast as possible, though minor delays or setbacks may occur. The shipping date and time specified by us is only an estimate and is not guaranteed.

6.4 Lost deliveries: We use registered post or courier service for all of our deliveries for reasons of reliability and convenience. Unfortunately, as with all delivery services, there are very rare circumstances where parcels do not arrive in the agreed time scale or they are lost completely. Under these circumstances, we endeavour to ensure that the item is delivered to you as soon as possible by contacting the delivery service and attempting to locate your parcel and have it delivered. You may also contact the delivery service yourself with the tracking number supplied to you in your despatch email. In the case of lost items, we cannot refund orders or send out a replacement until the delivery is confirmed to be lost.

6.5 Denial of receipt: In the case of a parcel being signed for, but the customer denies receiving the package, we will contact the postal service or the couriers to confirm delivery to the correct address. If this is available, it will be considered sufficient proof that the parcel was delivered correctly. In the case where several people reside at an address, it is your responsibility to ensure you obtain the parcel from the signatory.

6.6 If for any reason at all (not due to the Company's fault) you do not accept delivery of any of the goods then we may charge you an additional fee to cover any reasonable additional direct costs incurred by us as a result (including additional insurance, delivery, storage or similar charges).

6.7  When receiving your order you should inspect the packaging to ensure that it has not been tampered with in any way. If it does appear to be tampered with, you should refuse delivery. If the delivery is accepted and signed for, you will have entered into a contract to accept the item in its delivered state and, as such, we cannot assume liability for any subsequent issues surrounding loss or damage.

7. Prices

7.1 All of our prices are tax exempt.

7.2 Our prices change daily. Generally, we release new prices on a schedule and prices change at midnight only, and we also inform you of this scheduled price change in advance on the product page. However, we may also update prices during working hours.

7.3 All manufacturers generally have price increases throughout the years, due to increases in manufacturing costs and inflation. While we try to absorb as much of these costs ourselves, these price increases are unavoidable. We always aim to notify customers of pending price increases on the product details page.

7.4 We do not have control over prices listed on external sites, including Google cached listings, shopping feeds or any other site. We are not obliged to provide products for any price, which is listed on an external site. We do not have control of the rate at which search engines crawl our site, and therefore the information in the search results may not be indicative of up to date prices.

8. Returns and the cooling off period

8.1 Please ensure you have read our refund and returns policy and understand it fully. This does not affect your statutory consumer rights.

8.2 Refunds are processed as promptly as possible. Returns volume is unpredictable in seasonal periods - most refunds are processed on the day of receipt, but please allow up to a maximum 14 days for the refund to be complete.

8.3 Items, which have been worn, are not eligible under this refund policy. You may try product on, but not wear it to be eligible for a refund, you will be required to pay for the return postage costs.

8.4 If a visual defect is found with the item(s) on arrival (out of the box), you must notify us within 48 hours.

10. Risk and title change

10.1 Risk of loss and damage of products is assumed by you that from the moment the product(s) are delivered.
